Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

This collection of essays explore the long-standing,intricate relationship between law and faith. Faith in this context is to be read in the broadest sense, as extending beyond religion to embrace the knowledge, beliefs, understandings and practices which are at work alongside the familiar and seemingly more reliable, trusted and relatively certain content and conventionally accepted methods of law and legal reasoning. The essays deal with three broad themes. The first concerns the extent to which faith should be involved in legal (...) decision making. Ought decisions to aspire simply to right reason or ought faith-based models of decision-making to be incorporated into the legal system? If the latter, how is this best done? Ought faith to operate simply as a reason itself or ought it to help to structure the method by which legal decisions are reached? The second, and perhaps most familiar theme, stemming in part from rights discourse, is the extent to which law does, and ought to, respect the rights of those whose religious beliefs conflict with the dominant social norms and practices. Liberal democratic constitutions typically provide protection for religion and religious beliefs. Are these justified, and if so how? Can such protection as exists suffice from the perspective of the faithful, or does law's otherwise pervasive agnosticism make this impossible or illusory? Thirdly, questions of identity and difference arise. Assuming that most societies remain a mix of many faiths (religious and secular) and no faith, how should law and legal theory understand the varying and, it must be said, conflicting claims for recognition. Should we encourage conformity in the hope of reducing friction, or should we preserve and promote difference, seeking to understand others, whether groups or individuals, without removing that which makes them distinct? More radically and controversially, should we be more sceptical of individual and group claims to authenticity and see them rather as strategies in an ongoing power game? Faith after all, like reason and law, has never been far from politics and intrigue, especially in its institutional representation. Psychological Metaphysics is an exploration of the most basic and important assumptions in the psychological construction of reality, with the aim of showing what they are, how they originate, and what they are there for. Peter White proposes that people basically understand causation in terms of stable, special powers of things operating to produce effects under suitable conditions. This underpins an analysis of people's understanding of causal processes in the physical world, and of human action. In making a radical (...) break with the Heiderian tradition, Psychological Metaphysics suggests that causal attribution is in the service of the person's practical concerns and any interest in accuracy or understanding is subservient to this. Indeed, a notion of regularity in the world is of no more than minor importance, and social cognition is not a matter of cognitive mechanisms or processes but of cultural ways of thinking imposed upon tacit, unquestioned, universalassumptions. Incorporating not only research and theory in social cognition and developmental psychology, but also philosophy and the history of ideas, Psychological Metaphysics will be challenging to everyone interested in how we try to understand the world. I shall propose that the unlearned motives of persons are primary emotions. I am not surprised that many informed readers will wonder where I have been for the last five decades when even the conception of unlearned motives (instincts, drives, urges) has been shown to be little more than the result of undisciplined investigation? And here I am proposing that in the nature and dynamics of some emotions that persons experience we can gain more adequate understanding of human motives at (...) the unlearned level. During the last five decades I have spent most of my time teaching the histlDry of philosophy, metaphysics, philosophy of religion, ethics and theory of value, the psychology of personali ty, and th~ philosophy of personality. Increasingly I have paid special attention to the ways in which claims about ~the nature of man I influence the theory of motives, emotions, and feelings. What kept impressing me is the way in which the viii interpretation of the "findings" about motives, feelings, and emotion reflect unargued conceptions of human nature, or that the views of fundamental motives, feelings, and emotions unduly dominate the underlying conception of the person. In focusing attention first on the essential nature of a person I shall be discussing issues that are actually basic to our more analytical interpretation of the nature and dynamics of the primary motives or primary emotions. The Frame/Content theory deals with how and why the first language evolved the present-day speech mode of programming syllable “Frame” structures with segmental “Content” elements. The first words are considered, for biomechanical reasons, to have had the simple syllable frame structures of pre-speech babbling, and were perhaps parental terms, generated within the parent–infant dyad. Although all gestural origins theories have iconicity as a plausible alternative hypothesis for the origin of the meaning-signal link for words, they all share the problems of (...) how and why a fully fledged sign language, necessarily involving a structured phonology, changed to a spoken language. Words denoting “mother” in baby talk and in languages usually include nasal sounds, supporting Falk's suggestion that infant nasalized demand vocalizations might have motivated a first word. The linguistic contrast between maternal terms and paternal terms, which favor oral consonants, and the simple phonetic patterns of parental terms in both baby talk and languages also suggest parental terms could have been first words.

Arbib's gestural-origins theory does not tell us why or how a subsequent switch to vocal language occurred, and shows no systematic concern with the signalling affordances or constraints of either medium. Our frame/content theory, in contrast, offers both a vocal origin in the invention of kinship terms in a baby-talk context and an explanation for the structure of the currently favored medium.

Hurford presents a much-needed lowly origins scenario for the evolution of conceptual precursors to lexical items. But more is still needed on action, regarding both the message level of lexical concepts and the medium. We summarize our complementary action-based lowly origins (frame/content) scenario for the vocal auditory medium of language, which, like Hurford's scenario, is anchored in a phylogenetically old neurological dichotomy.

The aim of the present study was to provide support for the validation of the Teammate Burnout Questionnaire. Athletes from a variety of team sports completed the TBQ and the Athlete Burnout Questionnaire. Confirmatory factor analysis revealed acceptable fit indexes for the three-dimensional models of the TBQ and the ABQ. Multi-trait multi-method analysis revealed that the TBQ and ABQ showed acceptable convergent and discriminant validity. The preliminary validation of the TBQ indicates the utility of the scale to reflect athletes’ perceptions (...) of their teammates’ burnout and offers researchers the opportunity to quantitatively assess an important aspect of the social environment in the development of athlete burnout. This volume features 16 essays on the philosophy of technology that discuss its identity, its position in philosophy in general, and the role of empirical studies in philosophical analyses of engineering ethics and engineering practices. This volume is published about fifteen years after Peter Kroes and Anthonie Meijers published a collection of papers under the title The empirical turn in the philosophy of technology, in which they called for a reorientation toward the practice of engineering, and sketched the likely (...) benefits for philosophy of technology of pursuing its major questions in an empirically informed way. The essays in this volume fall apart in two different kinds. One kind follows up on The empirical turn discussion about what the philosophy of technology is all about. It continues the search for the identity of the philosophy of technology by asking what comes after the empirical turn. The other kind of essays follows the call for an empirical turn in the philosophy of technology by showing how it may be realized with regard to particular topics. Together these essays offer the reader an overview of the state of the art of an empirically informed philosophy of technology and of various views on the empirical turn as a stepping stone into the future of the philosophy of technology.
